State of Florida issues complaint against psychiatrist Fernando Mendez-Villamil

On January 11, 2013, the Florida Department of Health issued an administrative complaint against psychiatrist Fernando Mendez-Villamil, relative to his treatment of three patients with various antipsychotics, mood stabilizers, tranquilizers and stimulant drugs.

Villamil treated 3-year-old patient “AT” for ADHD for five years though there was nothing in the patient’s notes to show that Villamil assessed ADHD with any criteria.

There was no supporting documentation in the medical records to justify a diagnosis of ADHD. Villamil nonetheless continued to prescribe AT multiple prescriptions of drugs classes mentioned above in excessive and/or inappropriate quantities and/or combinations.

Villamil’s records fail to justify the amounts, frequency and combinations of the prescriptions. Further, the complaint points out several anomalies, such as prescribing AT the antipsychotic Abilify for “impulsivity” after noting that AT’s insight and judgment are good and that “this now 5 year old is able to take care of himself.”

The record contains ten more pages regarding similar conduct with two other patients.
